Consumers are becoming more aware of Joint Ventures disguising referral fees as legitimate profit distributions in the real estate industry as RESPA Violation Cases make the news.  The “Most Feared Question” is, “Are you as a real estate agent in a Joint Venture (JV) between your broker and a title company?” JV brokers and agents in the industry know consumers are turning elsewhere for real estate representation.  But some are refusing to end their JV’s simply due to profits gained from referrals. But, it’s a straight forward question that is closing the door for many agents. Where does the consumer turn for representation if they suspect their rights have been violated?

RESPA violations in Tennessee should be reported to the U.S. Department of Housing and Urban Development (HUD). For local, licensed, or state-specific issues, complaints can be filed with the Tennessee Real Estate Commission (TREC) or the Tennessee Division of Consumer Affairs

  • Federal Level (HUD): HUD enforces RESPA, which covers illegal kickbacks, fee-splitting, and unearned fees in settlement services. Complaints can be submitted to HUD.
  • Tennessee State Level:
    • Tennessee Real Estate Commission (TREC): Handles complaints against real estate licensees.
    • TN Division of Consumer Affairs (DCA): Mediates consumer complaints.
    • TN Real Estate Appraiser Commission: For appraisal-related issues. – TN.gov
